Terms & Conditions

These Terms and Conditions govern the use of coaching services and digital products provided by Smartify DOOEL Skopje (“the Company”). By purchasing any coaching package or using our services, you agree to the following terms.

Nature of Coaching

Coaching is a professional relationship between a coach and a client designed to support the development of personal or professional competencies and goal achievement. It is a voluntary, active, and accountable process. The success of coaching depends on the client’s engagement and responsibility to apply insights between sessions and in real-life environments.

Coaching Commitment
  • The Company provides coaching sessions led by a certified coach.
  • The sessions aim to support clarity, goal setting, self-reflection, and personal/professional growth.
  • Coaching is not a substitute for therapy, psychotherapy, legal, medical, or financial advice.
  • The client agrees to take full responsibility for their own decisions, actions, and results.
Confidentiality

All information shared during coaching sessions is treated as strictly confidential.
Exceptions to confidentiality apply in the following cases:

  • Where disclosure is required by law;
  • When there is a clear and imminent danger to the client or others;
  • In cases of anonymous sharing for professional supervision or quality assurance purposes, with the client’s identity fully protected.
Session Format and Duration
  • Coaching sessions are conducted online (via Zoom, Google Meet, or similar platforms) unless otherwise agreed in writing.
  • On-site (in-person) sessions may be available upon special arrangement, depending on location and availability.
  • Each session lasts 60 minutes.
  • Coaching packages must be used within 6 months from the date of purchase.
  • Sessions are scheduled in advance by mutual agreement between the client and coach.
  • The client is responsible for showing up on time and being present in a distraction-free environment.
  • Rescheduling or cancellation must be made at least 24 hours in advance. Sessions missed without timely notice are considered delivered and are non-refundable.
Fees and Payment
  • All coaching services are paid in advance unless otherwise agreed in writing.
  • Payment methods include credit card, bank transfer, or other accepted platforms.
  • Payment confirms your reservation of coaching time and is non-transferable to other individuals.
  • All prices are listed in local or relevant currency and may be subject to applicable taxes.
Delivery of Services
  • Coaching sessions are scheduled via email or online calendar in coordination with the client.
  • Digital products and coaching tools are delivered via email or user account after payment confirmation.
  • Clients are responsible for ensuring accurate contact information to avoid delivery issues.
Refund Policy
  • Refunds are not available for sessions already delivered or missed without prior cancellation.
  • If the coaching relationship is terminated before all sessions are used, the client may request a partial refund for unused sessions within the 6-month usage period.
  • The refund amount will be determined based on the number of unused sessions and the original package price.
  • If the client fails to use the sessions within 6 months of purchase, the entire package is considered expired and no refund will be issued.
  • Digital products are non-refundable once accessed or downloaded, unless proven defective.
Client Responsibility

By entering into a coaching relationship, the client agrees to:

  • Be open, honest, and actively engaged in the process;
  • Take responsibility for implementing insights between sessions;
  • Communicate directly if something in the process isn’t working;
  • Maintain a respectful and professional attitude during all interactions.

The coach reserves the right to end the coaching engagement if the client repeatedly fails to participate or shows a lack of commitment to the process.

Limitation of Liability

Smartify DOOEL Skopje and its coaches are not responsible for the decisions, actions, or results of the client before, during, or after coaching.
The client remains solely responsible for their mental, emotional, and physical wellbeing, and agrees not to hold the Company liable for any distress or outcomes perceived to be connected with the coaching.

Intellectual Property

All coaching tools, materials, session content, and digital resources provided by Smartify are the intellectual property of the Company or its partners.
They may not be reproduced, shared, sold, or used for commercial purposes without prior written consent.

Termination

Either party may terminate the coaching relationship by providing written notice (via email) at least 7 days in advance.
If any sessions remain unused and fall within the valid 6-month usage period, the client may request a partial refund.
The amount of the refund will be determined based on the number of unused sessions and the original package price.
If the client fails to use the sessions within 6 months of purchase, the entire package will be considered expired and no refund will be issued.

Applicable Law

These Terms are governed by the laws of the Republic of North Macedonia.
Any disputes arising out of these Terms or the services provided shall be resolved in accordance with the laws and jurisdiction of North Macedonia.
